Welcome to ThisThat (flagship product of Futural Solutions). By using this mobile application (Android/iOS), you are agreeing to comply with and be bound by the following terms of use. Please review the following terms carefully.

Acceptance of Agreement

You agree to the terms and conditions outlined in this Terms of Use Agreement (“Agreement”) with respect to our Mobile Application (the “Mobile Application”, this-that.in). This Agreement constitutes the entire and only agreement between this-that.in (“We”, “Us”, “Our”, “Futural Solution”, “Mobile Application”, “App”) and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Mobile application(s), the content, products or services provided by or through the Mobile application, and the subject matter of this Agreement. If you do not agree to all of the terms and conditions contained in the Terms of Use, do not access or use this Mobile Application.

Please read these Terms carefully before downloading, installing and using the App. By downloading, installing, accessing, browsing or using the App, you accept and agree to these Terms which bind you legally. The Terms are entered into for the benefit of Futural Solution who may enforce against you. If you do not agree to these Terms you are not permitted to use the App and you must immediately cease downloading, installing or using the App.

In order to use the App, you must have a compatible device. You confirm that you either own the applicable Device or if not owned by you, you have obtained permission to install and use the App on such Device. You accept responsibility for any use of the App on or in relation to such Device, whether or not such Device is owned by you or such use was made by you

1. Defined Terms

“Services” means our proprietary software applications offered or enabled via the App. All information (such as data files, written text, photographs, templates, graphics, formats or other images) which we may post to the App is referred to as “Content”. A “User” is an end customer of our services.

2. Security

The security of information transmitted through the Internet can never be guaranteed. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS AS TO THE SECURITY OF THIS MOBILE APPLICATION. YOU ACKNOWLEDGE ANY INFORMATION SENT MAY BE INTERCEPTED. WE DO NOT WARRANT THAT THE MOBILE APPLICATION OR THE SERVERS, WHICH MAKE THIS MOBILE APPLICATION AVAILABLE OR ELECTRONIC COMMUNICATIONS SENT BY US ARE FREE FROM VIRUSES OR ANY OTHER HARMFUL ELEMENTS. We are not responsible for any interception or interruption of any communications through the Internet or for changes to or losses of data. You are responsible for maintaining the security of any password, user Id, or other form of authentication involved in obtaining access to password protected or secure areas of the App. In order to protect you and your data, We may suspend your use of a client App, without notice, pending an investigation, if any breach of security is suspected

3. Third Party Information

Although We monitor the information on the App, some of the information may be supplied by independent third parties. While We make every effort to insure the accuracy of all information on the App, We make no warranty as to the accuracy of any such information

This App may contain links that will let you access other Web sites or other applications (“Third Party Sites”) that are not under our control. The links are only provided as a convenience and We does not endorse any of these sites. We assume no responsibility or liability for any material that may accessed on other Web sites reached through this App, nor does We make any representation regarding the quality of any product or service contained at any such site. We expressly disclaim any liability for loss or damage sustained by you as a result of the accessing and use of Third Party Sites.

We prohibit unauthorized links to this App and the framing of any information contained on this App or any portion of this App. We reserve the right to disable any unauthorized links or frames. We have no responsibility or liability for any material on other Web sites that may contain links to this App

6. Indemnity

All the things you do and all the information you submit or post to this App remain your responsibility. Indemnity is basically a way of saying that you will not hold us legally liable for any of your user content or actions that infringe the law or the rights of a third party or person in any way. Specifically, you agree to hold this-that.in, its affiliates, management, directors, employees, agents, and third party service providers harmless from and defend them against any claims, costs, damages, losses, expenses, and any other liabilities, including attorney’s fees and costs, arising out of or related to your access to or use of this App, your violation of this user agreement, and/or your violation of the rights of any third party or person

7. Account Termination

The user may close his account at any time. Account closing means that the further use of services with the use of current password and login shall no longer be possible. The user is responsible for closing his account. We reserve the right to close user’s account due to gross infringement of the provisions of these terms of use or in the event of illegal use of the offered services. We shall not be liable for damage suffered by the user arisen due to the suspension or closing the account by the user or for other reasons arising from the user’s fault

8. Content Responsibility

The user is responsible for all the content/comments (including but not limited to text and graphics) created and published while using the services provided by us. We do not bear any responsibility for the contents/comments created by the user while using the services provided by us

9. Modification to Terms

These Terms apply to the App, including any updates or supplements thereto. We reserve the right to modify the terms and conditions of this Agreement or its policies relating to the Service at any time, effective upon posting of an updated version of this Agreement on the Service. You are responsible for regularly reviewing this Agreement. Use of the Service after any such changes shall constitute your consent to such changes.

From time to time, updates to the App may be made available through the App Store and Play Store. Depending on the update, and whether you utilized the App Store or Play Store to download and access the App, you may not be able to use the App until you have installed the latest version.

10. License restrictions

Except as expressly permitted under these Terms, and unless prohibited by applicable law, you agree:

a. not to copy, reproduce, republish, reuse, upload, post, transmit or distribute any content presented in or provided by the App, including without limitation for public or commercial purposes, including any text, images, audio and video, except as permitted by the App’s sharing function;

b. not to rent, lease, sub-license, loan, distribute, time-share, or translate the App in any way;

c. not to make alterations to, or modifications of, the whole or any part of the App, or permit the App or any part of it to be combined with, or become incorporated in, any other programs;

d. not to disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the App;

11. Additional restrictions

You agree:

a. not to use the App in any unlawful manner, for any unlawful or criminal purpose, or in any manner inconsistent with these Terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App;

b. not to use the App to record, post or transmit any information that is defamatory, threatening, abusive, offensive, obscene, indecent, discriminatory or is otherwise objectionable or infringes on third party rights;

c. not to use the App in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users, or restrict or inhibit any other users from using the App (including by hacking or defacing the App); and

d. not to collect or harvest any information or data from the App or our systems or attempt to decipher any transmissions to or from the servers running the App, including, without limitation, by using any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape,” “data mine” or in any way gather the App content or reproduce or circumvent the navigational structure or presentation of the App without our prior written consent.

You confirm that you are of legal age in India to form a binding contract and hereby agree to be bound by these Terms. If you are an employee or other representative of a business or other entity and you are using the App in your representative capacity, then you hereby represent that you are authorised to use the App as a representative of the entity and agree to these Terms on behalf such entity.

13. Law & Jurisdiction

To the extent permitted by applicable law, these Terms are governed and construed by the laws of the state of Haryana, India and you consent to the non-exclusive jurisdiction of the Haryana courts. We retain the right to bring proceedings against you for breach of these Terms in your country of residence or other relevant country.
